Notice from the Posey County Area Plan Commission

At the July meeting of the Posey County Area Plan Commission (APC), a discussion was held about upcoming amendments to the zoning ordinance, which includes sections concerning wind and solar sites. At the July meeting, a tentative date was discussed for the public hearing which will take place prior to any discussion and adoption of zoning amendments by the APC. This Notice is issued to clarify that the August 28, 2019 date was a tentative date and was discussed to make sure APC members kept the date clear in the event that the ordinance was ready for public hearing by that date. The amendments to the ordinance are still being drafted and there will be no public hearing on August 28, 2019. Once the amendments are prepared and presented in draft to the APC, the public hearing will be set and the amendments will be published in the newspapers as required. The Notice will include the date, time and place of the public hearing. POSEY COUNTY AREA PLAN COMMISSION GUIDELINES FOR OBTAINING LAND USE PERMIT

If you are remodeling or building in Posey County

Please give our office a call if you need information on zoning, subdividing or wanting to operate a business or placing a mobile home.

To obtain a Land Use Permit, the following is required:

    1. A brief legal description of the property (copy of deed or property tax statement)
    2. A plot plan (hand drawing) showing how and where new structure or addition will be placed on the property (click here to see a sample). Also include any road or street abutting your property.
    3. Show all existing buildings.
    4. Show (by arrows) how many feet new structure will be from your property line: Front, Back and Sides.
    5. Land Use Permit fee-

SPECIAL USE/VARIANCE/REZONING/SITE DEVELOPMENT PLAN REQUIREMENTS AND PROCEDURES

* Complete legal description of property. Survey report, tax statement or deed.

*Filing Fee required at time of filing.

Fees: Special Use $100.00  Mobile Homes $ 75.00 Variance $100.00 Rezoning $100.00 + Recording Fee (to be determined) Site Development Plan $ 50.00

* Detailed plot plan/site plan (showing all existing structures). Show placement of new construction that requires hearing. Showing how many feet from all property lines. Show how many feet from all existing structures.

* Site Development Plans see Section 153.223  (Click Here to Download a Copy)

* If lease/rent is involved-copy oflease/rent agreement

*Approval of land owner

* If business, need detail of operating time and type of business. Show on plot plan what part of property business will be located.

*There is a list of responsibilities for the applicant that will be gone over and will need to be signed at the time of filing. This will be explained and gone over in detail at that time. * Filing deadline is the 2nd Thursday of each month to be heard at the following meeting.

COMPLAINT FORM

Any person may file a complaint whenever a violation of this ordinance occurs, or is alleged to have occurred. Such complaint shall be filed in writing with the Area Plan Commission and shall state fully the causes and basis of such complaint. The Area Plan Commission shall record such complaint properly, immediately investigate and take action thereon as provided by this Ordinance.
