Can the Judge or court staff give me legal advice?
No. The judge and court staff are prohibited by law from providing legal advice or recommending a particular attorney. Parties are encouraged to seek legal counsel if they have questions regarding filing a case or if they have questions about a pending case.
How do I dismiss a pending divorce?
Petitioner must come in to the court office with a valid photo ID and sign a written Petition for Dismissal.

Petitioner must come in to the court office with a valid photo ID and sign a written Petition for Dismissal.
How long do I have to wait for a final hearing on a divorce matter?
Final hearings can be set no sooner than sixty (60) days after a Petition for Dissolution of Marriage has been filed. If parties are in full agreement on all matters, dissolution may be granted after sixty (60) days. If no agreement, parties will be ordered to mediation. Once mediation is completed a final / contested hearing may be scheduled.
Are Child In Need of Services (CHINS) cases open to the public?
No. Only parties and attorneys to each case are allowed in the courtroom during a CHINS hearing. All others must wait in the foyer.
What are the residency requirements to file for divorce in Posey County, Indiana?
At least one party must have lived continuously in the State of Indiana for at least six (6) months and lived continuously in Posey County at least three (3) months immediately prior to filing for divorce.
What is the monetary limit for small claims?
Effective July 1, 2020, there is an $8,000 limit on small claims cases. If one party is an LLC or Corporation, and if the claim exceeds $1,500, the party MUST be represented by counsel.
What are the fines for local Ordinance Violations?
Each violation carries a $10 fine plus court costs of $135. Default Judgment raises the fine to $50. Repeated incidents can increase the fine in $50 increments. Ordinance Violation hearings are held once per month, usually on a Monday morning.
